The ongoing case of the custody battle between Lisa Miller and her ex-partner Janet Jenkins will not be heard by the Supreme Court; they have chosen not to take issue with the 2009 ruling that Janet Jenkins deserves custody of their daughter despite not being her biological mother.
Miller’s whereabouts are still unclear – she is at this point believed to be hiding out in either Colorado or Ecuador with her daughter, Isabella, while the Christian fundamentalist groups to which she belongs fund her legal battle. The Vermont Supreme Court is also supporting the original decision of the family court that awarded full custody to Jenkins, a landmark case that was affirming of the parenting abilities and legitimacy of non-biological parents and same-sex parents everywhere.
Since Miller is still on the run with Isabella and their whereabouts are unknown, it will be difficult to enforce this ruling, but we hope that Isabella and Janet Jenkins can be reunited soon.
